Welcome to Fund Your Film: the Screen Finance Kit, a reference website, digital book and printed book created and published by Netribution (a limited company registered in England, number 3912820), available at fundyourfilm.com, referred to here as 'the service'.
These Terms & Conditions ('Terms') are a contract between Us and You that spells out your rights and our rights relating to this site.
We provide the service, including subscription access to paying members, the provision of downloads, mailouts, and responding to emails as quickly as possible.
In turn, Netribution grants you a personal worldwide license to access this website - and, if eligible, the subscription areas. We are a small operation created for film producers and filmmakers by filmmakers, producers and people working in film - and we ask that you follow these terms and treat this website with respect.
You are NOT permitted to interrupt the serving of our website, introduce malicious code, assist anyone in misusing the website in any way, or use the website to violate the law, or the safety or dignity of another person in any way.
Payments made to this site are for the products and services detailed under each offer. They are not an investment, and are not recoupable or refundable in any way. Instead they pay for a number of products and services, delivered at point of payment (and sometimes later).
The fundraising campaign aims to run for up to a year - this may be extended or reduced at our discretion.
We will produce as much content and functions as we can for the money that is raised. Backers receive only as much content as we are able to produce through this campaign based on money rasied. If we do not reach our target of £32,000 we will only produce as much as we have raised funding to support, e.g., if we do not reach Stage 5 - Printing a Book - there will be no printed book.
If we do not reach our Stage 1 target of £1,500, the campaign will end, and all backers will be refunded.
Under the Consumer Protection (Distance Selling) Regulations 2000 you have seven working days to change your mind and cancel this agreement in return for a refund, provided that you have not already downloaded any digital books or documents from this website (this does not include HTML/CSS/JS and image files downloaded automatically by your browser while you visit the website). Downloading a file signals the start of your use of this service.
Membership & access
All backers will have access to services and content as detailed in the offer, at the level they are backing.
Online access to those products and services will last for one year after the completion of the campaign, or one year after the point of buying a support package, whichever is later.
All downloaded content will be usable indefinitely, for any purpose within the limits of the license agreement below.
You should be over 18 to use the subscription, member-access & content submission parts of the website (such as comments). If you are under 18, you confirm that you have permission of your parent or guardian to do this.
This service contains links to other sites that are not owned or controlled by Netribution Ltd. Netribution accepts no responsibility for the content and practices of external websites. These Terms apply only to this Website.
Content from the service that you download, and exclusive online content, is available for you - and you alone - to view, read and print out, unless otherwise stated.
Publishing, selling, re-using in other forms, making available on a company intranet, or distributing content that we own digitally or in print or any other method, is not permitted under this agreement - except where either:
a) the content has been clearly labelled as available under a Creative Commons license;
b) the author of the content or the publisher Netribution has permitted this explicitly over email or in writing;
The agreement is personal to you (or your organisation). You (or your organisation) may not assign, sublicense or otherwise transfer any of your rights under these terms. You shall not sell, licence, rent, or otherwise use or exploit any content for commercial use or in any way that violates third party rights. Your contribution does not entitle you to any rights in or to Fund Your Film, including without limitation any ownership, control or intellectual property rights, except as expressly described above in a) and b).
To ensure you have maximum freedom to move files between different platforms and e-readers, we do not use digital rights management (DRM) to enforce this. A breach of this part of the Terms ends all our obligations to you within the Terms and could result in terminating your membership account and other further actions.
Re-use of content & citations
Where fair-dealing/fair-use/creative commons exerts take place, please make sure you credit the author of the relevant content, the date, the book and provide a link (if online) to FundYourFilm.com.
We may, with our sole discretion and without any forewarning, suspend or terminate your account for violating these Terms, or for any other reason we choose and will try to notify you of this. We can remove your submitted content without any forewarning, for any reason we choose. We can also remove the content we post on our site, without any forewarning, for any reason we choose.
Privacy and data protection
This service is covered by our privacy and cookies policy. Use of the service both as a visitor and registered and logged-in user indicates agreement to this policy.
To process your use of this service - such as making an account, buying something or joining our mailing list, you will need to provide information to us and we will process it. You are responsible to ensure that information is accurate and up-to-date.
This site is hosted in London, and so comes under UK surveillance and data protection laws.
Using this website
Funding information changes all the time. While we take our best efforts to ensures that our information is up-to-date and accurate we can offer no guarantee about this, and take no legal responsibility for the accuracy of the information.
This service can be used as a starting point but you should still check with the relevant fund or organisation about details, application criteria, time sensitive deadlines and any other formal and informal requirements.

NETRIBUTION LTD EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. NETRIBUTION LTD MAKES NO WARRANTY THAT THE SOFTWARE, SERVICES AND/OR ANY OTHER CONTENT YOU ACCESS FROM FUNDYOURFILM.COM WILL MEET YOUR REQUIREMENTS, OR THAT THE SOFTWARE OR SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE; NOR DOES NETRIBUTION LTD MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICE OR THAT DEFECTS IN THE SOFTWARE WILL BE CORRECTED.

Limitation of Liability
NOTHING IN THESE TERMS SHALL EXCLUDE OR LIMIT NETRIBUTION LTD'S LIABILITY FOR LOSSES WHICH MAY NOT BE LAWFULLY EXCLUDED OR LIMITED BY APPLICABLE LAW.
NETRIBUTION LTD SHALL NOT BE LIABLE TO YOU FOR ANY INDIRECT OR CONSEQUENTIAL LOSSES WHICH MAY BE INCURRED BY YOU. THIS SHALL INCLUDE; (I) ANY LOSS OF PROFIT (WHETHER INCURRED DIRECTLY OR INDIRECTLY); (II) ANY LOSS OF GOODWILL OR BUSINESS REPUTATION; (III) ANY LOSS OF OPPORTUNITY; OR (IV) ANY LOSS OF DATA SUFFERED BY YOU;
Netribution Ltd shall not be liable for any loss or damage which may be incurred by you as a result of:
- any reliance placed by you on the completeness, accuracy or existence of any content, or as a result of any relationship or transaction between you and any writer whose content appears on our service;
- any reliance placed by you on the completeness, accuracy or existence of any advertising, or as a result of any relationship or transaction between you and any advertiser or sponsor whose advertising appears on our service;
- any changes which Netribution Ltd may make to the service, or for any permanent or temporary cessation in the provision of the service (or any features within the service);
- the deletion of, corruption of, or failure to store, any content and other communications data maintained or transmitted by or through your use of the service;
- your failure to provide the service with accurate account information;
- your failure to keep your password or FundYourFilm.com account details secure and confidential. The limitations on Netribution's liability to you above shall apply whether or not Netribution Ltd has been advised of or should have been aware of the possibility of any such losses arising.
You agree to indemnify, defend and hold harmless Netribution and it's officers and employees from any claim, demand, including reasonable legal fees, asserted by any third party due to or arising out of or conduct of the service.
We may modify these Terms at any time. If we make changes to this document that materially alter its effect, we will make it clear to you in advance by email and/or on the website - and will specify at the bottom of this document the date of modification.
The terms and conditions of this agreement and any dispute or claim arising out of it, including non-contractual disputes or claims, shall be governed by and construed in accordance with the law of England and Wales, and the parties submit to the exclusive jurisdiction of the English courts.
